Terms of Service
These terms govern your use of FlashDesk (the “Service”).
1. Scope
These Terms define the conditions for providing the Service and the rights and obligations between the operator and the user. By using the Service, you agree to these Terms.
2. Definitions
- “Operator” means the party providing the Service (see the Contact page).
- “User” means any individual or entity using the Service.
- “Host” means the device/environment being remotely operated.
- “Viewer” means the device/environment used to operate a Host.
- “Paid plan” means a plan provided for a fee, such as Pro.
- “Seat” means the unit defined by the Operator for concurrent usage under a paid plan (primarily concurrent Viewer devices).
3. Accounts and Environment
- You must keep your registration information accurate and up to date.
- You are responsible for safeguarding authentication credentials (IDs, tokens, passwords, etc.) and must not disclose them to third parties.
- You are responsible for preparing and maintaining devices, networks, OS, and peripherals required to use the Service.
- If a minor uses the Service, they must obtain consent from a legal guardian.
4. Use Conditions (Remote Access)
- You may use remote control, file transfer, SSH, and related features only with proper authorization from the Host owner/administrator.
- You must handle information obtained through the Service (screen content, inputs, files, etc.) in compliance with laws and third-party rights.
- If you use recording/playback features, you must operate them appropriately in accordance with consent, internal policies, and applicable laws.
5. Plans, Fees, and Payment (Paid Plans)
- Paid plan details, pricing, billing unit (seats), payment methods, renewal, and cancellation follow the conditions displayed on this site or in the Admin console.
- Paid plans renew automatically unless canceled through the prescribed procedure.
- The Operator delegates payment processing for paid plans to Stripe, Inc. (“Stripe”). Payment may be completed via Stripe-provided products (e.g., Checkout). Seat changes, invoice/receipt viewing, and payment method updates are performed via Stripe’s Billing Portal. Sensitive payment data such as card numbers and security codes are handled by Stripe and are not stored by the Operator. Stripe’s handling of information is governed by Stripe’s terms and privacy policy (e.g., Stripe Terms, Stripe Privacy Policy).
- Fees paid are non-refundable except where required by law.
Note: The Free plan is intended for personal, non-commercial use. For organizational or commercial use, please use a paid plan.
6. Prohibited Activities
You must not do any of the following while using the Service:
- Violate laws or public order and morals
- Compromise the security of the Service (unauthorized access, vulnerability scanning, reverse engineering, etc.)
- Access, operate, or intrude into third-party devices/accounts without authorization
- Distribute malware, spam, launch DDoS attacks, or otherwise harm others
- Infringe intellectual property, privacy, reputation, or other rights or interests of others
- Interfere with the operation of the Service or use it for improper purposes
- Any other conduct deemed inappropriate by the Operator
7. Intellectual Property
All intellectual property rights in the Service and this site (copyrights, trademarks, etc.) belong to the Operator or rightful owners. The license granted under these Terms does not imply any transfer or sublicensing of such rights.
8. Suspension and Termination
The Operator may suspend your use of the Service or terminate your registration without prior notice if you violate these Terms or if the Operator determines it is necessary for safe operation of the Service.
9. Changes, Interruption, and Discontinuation
The Operator may change the Service or interrupt it for maintenance, incidents, or other reasons. The Operator will endeavor to provide prior notice when reasonably possible, but may do so without notice in urgent cases.
10. Disclaimers and Limitation of Liability
- The Operator makes no warranties regarding completeness, accuracy, continuity, fitness for a particular purpose, or non-infringement.
- The Operator is not liable for damages arising from your use of the Service except in cases of willful misconduct or gross negligence.
- If the Operator is liable, liability is limited to direct and ordinary damages, and (for paid plans) capped at the total fees paid by you to the Operator in the past 12 months.
- Disputes between you and third parties must be resolved at your own responsibility and expense.
11. Changes to These Terms
The Operator may modify these Terms as necessary. For material changes, the Operator will provide prior notice by reasonable means. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Operator’s location as the court of first instance.
